Purchase Policy

1. ACCEPTANCE

1.1 These terms and conditions (Terms) are entered into between Australia Youth Film Festival Pty Limited, (referred to as we, us or our) and the individual (you and your) who has purchased a ticket to attend Australia Youth Film Festival (Festival), together the Parties and each a Party.

1.2 You accept these Terms when you purchase a ticket to attend the Festival (Ticket).

2. TICKETS

2.1 Tickets will be scanned before entry to the Festival.

2.2 Tickets are non-transferable and non-refundable unless explicitly stated otherwise.

2.3 Duplicate or copied tickets will not be honoured, and we are not responsible for any loss or theft of tickets.

3. ADMITTANCE

3.1 You acknowledge and agree that your Ticket entitles you to admittance to the Festival

3.2 Any and all other costs associated with your attendance (including without limitation any food, beverage, travel and/or accommodation expenses) is your sole responsibility and we shall have no liability for such costs.

4. ATTENDANCE

4.1 You agree to comply with the Festival’s dress code. We reserve the right to refuse entry or request your removal without refund if you fail to comply.

4.2 Please arrive promptly at the advertised door opening or start time. Late arrivals may not be permitted to enter the theatre until a suitable break or intermission.

5. CHANGES OR CANCELLATION OF THE FESTIVAL

5.1 Cancellation of the Festival. We reserve the right to cancel the Festival at our sole discretion for any reason and at any time. In the event of cancellation for any reasons other than due to a Force Majeure Event, we will refund you the Ticket purchase price. In all circumstances, we will use reasonable endeavours to notify you of such cancellation.

5.2 In the unlikely event of cancellation of the Festival, our total aggregate liability to you is limited to the refund of the Ticket purchase price excluding credit card and payment processing fees, and we will not be liable to you for any expenditure, damage or loss incurred by you as a result of the cancellation.

5.3 Postponement of the Festival. If the Festival is postponed by us, we will provide you with a substitute Ticket for the new Festival. No refunds will be provided if the Festival is postponed. You are therefore requested to keep your proof of purchase and/or Ticket.

5.4 Changes to the Festival. We reserve the right to make any changes to the Festival at any time without prior written notice. For example, such changes may include but are not limited to, changing the Festival name, themes, content, programme, speakers, hosts, moderators, time, date, and/or the venue. We reserve the right to do so at any time and will not be liable to you for any cost incurred by you as a result (including, without limitation, travel, accommodation and other expenses). We will endeavour to notify you as soon as reasonably practicable of any substitutions, postponements, or changes.

6. FOOD AND BEVERAGES

6.1 This general admission ticket does not include refreshments. Food and drinks may be purchased separately from the café and bar at ACMI.

6.2 Alcohol may only be purchased and consumed by persons aged 18 and over. Valid ID may be required.

6.3 We accept no responsibility for attendee conduct under the influence of alcohol.

7. SECURITY

7.1 During the Festival, you agree to conduct yourself in an orderly manner and shall not act in any manner which causes offence, annoyance or inconvenience to other attendees, nominees, VIP’s, staff or speakers.

7.2 During the Festival, you agree to not obstruct or otherwise enter the stage area.

7.3 You accept and acknowledge that security will be present at the Festival. You agree to comply with their reasonable requests and instructions.

7.4 We may, at our sole discretion, and without any liability or obligation to refund, reserve the right to request your removal from the Festival.

8. HEALTH & SAFETY

8.1 You agree that you will not attend the Festival if you are feeling unwell or have been in contact with someone with a contagious illness.

8.2 You acknowledge and assume any risks associated with attending the Festival and release the us from any liability arising from health-related issues.

9. PHOTOGRAPHY, AUDIO & VIDEO RECORDING

9.1 During the Festival, you are entitled to take photographic, audio, and video recordings.

9.2 You grant us the right at the Festival to record, film, livestream, photograph or capture your likeness in any media and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to us includes, but is not limited to, the right to edit such media, the right to use the media (alone or together with other information), and the right to allow others to use and/or disseminate the media.

10. GENERAL

10.1 Entire agreement: This Agreement contains the entire understanding between the Parties, and supersedes all previous discussions, communications, negotiations, understandings, representations, warranties, commitments and agreements, in respect of its subject matter.

10.2 Force Majeure Event: Any event or circumstance which is beyond a Party’s reasonable control including but not limited to, acts of God including fire, hurricane, typhoon, earthquake, landslide, tsunami, mudslide or other catastrophic natural disaster, civil riot, civil rebellion, revolution, terrorism, insurrection, militarily usurped power, act of sabotage, act of a public enemy, war (whether declared or not) or other like hostilities, ionising radiation, contamination by radioactivity, nuclear, chemical or biological contamination, any widespread illness, quarantine or government sanctioned ordinance or shutdown, pandemic (including COVID-19 and any variations or mutations to this disease or illness) or epidemic.

10.3 Governing law: This Agreement is governed by and construed in accordance with the laws of the State of Victoria and the laws of the Commonwealth of Australia. The Parties irrevocably submit to the exclusive jurisdiction of the courts of Victoria and of the Commonwealth of Australia.

10.4 Severability: If any part of this Agreement is found to be invalid or of no force or effect under any applicable laws, executive orders or regulations of any government authority having jurisdiction, this Agreement will be construed as though such part had not been inserted herein and the remainder of this Agreement will retain its full force and effect.

10.5 Waiver: No waiver by either party of any provisions of this Agreement will amount to a waiver of any other provision of this Agreement unless made in writing and signed by the party against whom the waiver would have been enforced.
